On Children: Legitimate (FC Art. 54
8), if conceived or born before judgment of annulment.
On Property:
1. Absolute Community of Property or Conjugal Partnership of Gains (FC Art. 50) will be dissolved and liquidated.
2. The spouse in bad faith will forfeit his net profits in favor of the common children or, if there are none, the children of the guilty spouse by a previous marriage, or in default of children, the innocent spouse.
3. Donation propter nuptias given to the spouse in bad faith by the innocent spouse is revoked by operation of law.
The Family Home: The conjugal dwelling and the lot on which it is situated shall be adjudicated to the spouse with whom the majority of the common children choose to remain. (FC Arts.102 and 129)
On rights & obligations between the former spouses: Terminate, including mutual support.
On presumptive legitimes of the common children: Presumptive legitime is given. (FC Art. 50)
On use of surnames: Wife may resume her birth name. (NCC Art. 371)
On hereditary rights of former spouses: The guilty spouse shall be disqualified to inherit from the innocent spouse by testate or intestate succession.
On remarriage: Either of the former spouses may marry again after compliance with FC Art. 52; otherwise, the subsequent marriage shall be null and void.
